1. Who We Are
8118 Capital LLC FZ ("Company," "we," "us"), a company incorporated under the laws of the United Arab Emirates, operates tr8de.ai (the "Platform"), currently in beta. This Privacy Policy explains how we collect, use, share and protect your personal data when you use the Platform, and the rights you have over it. It applies together with our Terms & Conditions and Cookie Policy.
2. Data We Collect
We collect the following categories of personal data, depending on how you use the Platform:
- Identity and contact data — such as your name, email address, and account details you provide when you register or communicate with us. If you register or sign in using a social account (such as Google or Facebook), we receive basic profile information from that provider, such as your name, email address and profile picture.
- Technical data — such as your IP address, device and browser information, and approximate location (such as country) derived from your IP address.
- Usage data — how you interact with the Platform, including features used and activity timestamps.
- Transaction and financial data — such as platform credit purchases and balances, deposits and withdrawals, trading activity on accounts you connect, and exchange API keys, passphrases and secrets, which we store encrypted.
- Communications — messages you exchange on the Platform and with Platform AI assistants, and communications you send to support.
- Content you create — strategies, bot configurations, code, files and images you upload or generate on the Platform.
- Identity verification data — where we ask for it.
3. How Communications Work
Messages exchanged on the Platform are encrypted in transit and at rest. Conversations with Platform AI assistants are processed by our AI service providers to deliver the feature. We access communications only where necessary to provide, support and secure the Services, or where required by law.
4. Why We Use Your Data
We process your personal data to: provide, operate and improve the Platform and its features (including bots, marketplace, backtesting and AI features); process payments, credits and payouts; provide user support; keep the Platform secure and prevent fraud, abuse and manipulation; meet legal, tax, regulatory, sanctions and anti-money-laundering obligations; and respond to lawful requests. Where required by law, we ask for your consent before processing that requires it, and you may withdraw consent at any time without affecting prior processing.
5. Sharing
We share personal data only with: service providers that help us run the Platform (such as cloud hosting, AI, email and payment-verification providers) under confidentiality and data-protection commitments; professional advisers; authorities, where required by law or to protect our rights; and a buyer in the event of a merger, acquisition or sale of assets. We do not sell your personal data.
6. International Transfers
The Platform operates globally: your data may be processed and stored in the United Arab Emirates, Switzerland and other countries. Where we transfer personal data across borders, we apply safeguards such as standard contractual clauses to protect it.
7. Retention
We keep your personal data only as long as necessary for the purposes in this Policy, to comply with legal obligations (including accounting and anti-money-laundering record-keeping), to resolve disputes and to enforce our agreements. Where we no longer need it and no law requires us to keep it, we delete or anonymise it. Backup copies may persist for a limited additional period, consistent with our backup practices.
8. Security
We use administrative, technical and physical safeguards designed to protect personal data, including encryption of data in transit and at rest, encryption of exchange API keys, and access controls limiting data to personnel who need it to do their jobs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security; if you suspect a breach, contact us immediately.
9. Your Rights
Where the law of your jurisdiction gives you data-protection rights, you may ask us to: access, correct, delete, restrict or object to the processing of your personal data; receive a copy of it in a portable format; and withdraw consent where processing is based on it. You may also lodge a complaint with your local supervisory authority. To exercise any right, contact us using the details below. We may need to verify your identity first, and some requests may be limited where we must keep data for legal reasons or to protect the rights of others. Where we cannot fulfil a request, we will tell you why.
10. Minors
The Platform is not directed at anyone under 18, and we do not knowingly collect data from children. If you believe a child has provided us personal data, contact us and we will delete it.
11. Marketing
Where we send marketing messages, you can opt out at any time using the link in the message or by contacting us. We may still send you service-related communications, which are not marketing.
12. Cookies
13. Changes During Beta
During the beta phase we may update this Privacy Policy at any time by posting the new version on the Platform; the published version is in force, and your continued use constitutes acceptance. After beta, material updates will be presented for your acceptance or provided on notice.
